This book discusses in dialogue form the basic principles of mathematics and its applications including the question: What is mathematics? What does its specific method consist of? What is its relation to the sciences and humanities? What can it offer to specialists in different fields? How can it be applied in practice and in discovering the laws of nature? Dramatized by the dialogue form and shown in the historical movements in which they originated, these questions are discussed in their full (...) complexity, yet are easily comprehended. The first dialogue, whose chief actor is Socrates, leads the reader to the source of modern mathematics in Athens in the 5th Century BC. The second dialogue, featuring Archimedes, takes place during the siege of Syracuse in 212 BC and shows the birth of applied mathematics. The third dialogue occurs in the year 1633 in Rome, its chief character being Galileo Galilei who fully realized the central importance of the mathematical method in discovering the laws of nature. Alfréd Rényi was born in Budapest Hungary in 1921. He studied mathematics and physics at the University of Budapest and received his Ph. D. from the University of Szaged in 1945. Since 1950 he has been Director of the Mathematical Research Institute of the Hungarian Academy of Sciences and since 1952 a professor at the University of Budapest. Dr. Renyi was a visiting professor at Michigan State University in 1961, at the University of Michigan in 1964 and at Stanford University in 1966. His main fields of research are probability theory, mathematical statistics and information theory, and he has also worked in analytic number theory as well as in various branches of analysis, combinatorial analysis and geometry. Bolotin’s work consists of a very literal translation of the Lysis and a detailed commentary, which pays attention to what is only implied as well as to what is actually stated by the dialogue’s characters. The translation is a model of precision; an occasionally awkward expression is a small price to pay for the faithfulness to the original text provided for the Greekless reader.

Il y a vingt-cinq ans, j’étais un étudiant de doctorat intéressé par la philosophie d’Aristote et à la recherche d’un sujet de thèse. Au cours de mes études supérieures, j’ai eu la chance d’étudier l’Éthique à Nicomaque avec Rémi Brague et Les Politiques avec Judith Swanson. Ces deux érudits m’ont, à leur façon, fait prendre conscience de l’importance d’enquêter sur le public cible des œuvres d’Aristote. Tous deux parlaient en bien du livre Le philosophe et la cité (Les Belles Lettres, (...) 1982) de Richard Bodéüs, qui venait d’être traduit en anglais sous le titre The Political Dimensions of Aristotle’s Ethics (State University of New York Press, 1993). Il se trouva qu’un jour de printemps, ayant été appelé à siéger comme juré, je pris avec moi mon tout nouvel exemplaire du volume de Bodéüs. Heureusement, le jury ne fut pas convoqué, mais on ne me laissa pas partir avant la fin de l’après-midi. Aussi passai-je toute la journée au palais de justice à lire l’ouvrage de Bodéüs et à réfléchir à la relation entre le concept de justice déployé dans l’Éthique à Nicomaque et les analyses des constitutions qu’on trouve dans Les Politiques. Je découvris alors une réflexion savante, riche et profondément historique, portant sur la façon de comprendre les divers traités d’Aristote sur «la philosophie des choses humaines» (EN 10.9.1181b15). C’est ainsi que je fus mis sur la voie du sujet de sur lequel porterait ma thèse : la nature de la justice politique chez Aristote. C’est aussi ainsi que j’en vins à penser en compagnie de l’un des plus éminents spécialistes et traducteurs d’Aristote du siècle dernier. En 2018, la Northeast Political Science Association annonça que sa réunion annuelle allait se tenir à Montréal et invita ses membres à soumettre des contributions dans les deux langues officielles canadiennes. Étant donné que Montréal abrite également l’université dans laquelle Bodéüs avait enseigné, l’Université de Montréal, il m’est immédiatement venu à l’esprit de proposer un panel bilingue pour explorer la philosophie d’Aristote à la lumière de son ouvrage novateur, Le philosophe et la cité, qui fut déterminant pour mon parcours intellectuel. Deux panels furent constitués. Le premier rassemblait les participants anglophones : Jordan Jochim (Cornell University), Kevin Cherry (Richmond University) et moi-même (Quinnipiac University), et fut présidé par Jill Frank (Cornell University). Le second panel rassemblait les participants francophones : Léa Derome (Université McGill), Timothée Gautier (Université Paris 1 — Panthéon-Sorbonne), Louise Rodrigue (Collège universitaire dominicain), et fut présidé par Elsa Bouchard (Université de Montréal). Bodéüs, qui est à présent professeur émérite, accepta généreusement de lire toutes les contributions à l’avance et, combattant un mal de gorge le jour de la conférence, accompagna chacune d’entre elles de commentaires à la fois perspicaces et magnanimes. N’ayant pas pu inclure toutes les présentations de la conférence de novembre 2018, ce numéro de Dialogue comprend les versions révisées de trois contributions : mon “ὁμόνοια: The Hinge of Aristotle’s Ethics and Politics?”, la contribution de Kevin Cherry, “Lawgivers, Virtue, and the Mixed Regime: Reflections on Richard Bodéüs’s The Political Dimensions of Aristotle’s Ethics,” et celle de Louise Rodrigue, «La conception aristotélicienne de la servilité dans l’Éthique et la Politique». Smart grids are rolling out internationally, with the United States nearing completion of a significant USD4-plus-billion federal program funded under the American Recovery and Reinvestment Act. The emergence of smart grids is widespread across developed countries. Multiple approaches to analyzing the benefits of smart grids have emerged. The goals of this white paper are to review these approaches and analyze examples of each to highlight their differences, advantages, and disadvantages. This work was conducted under the auspices of a joint U.S.-China (...) research effort, the Climate Change Working Group Implementation Plan, Smart Grid. We present comparative benefits assessments of smart grid demonstrations in the U.S. and China along with a BA of a pilot project in Europe. In the U.S., we assess projects at two sites: the University of California, Irvine campus, which consists of two distinct demonstrations: Southern California Edison’s Irvine Smart Grid Demonstration Project and the UCI campus itself; and the Navy Yard area in Philadelphia, which has been repurposed as a mixed commercial-industrial, and possibly residential, development. In China, we cover several smart-grid aspects of the Sino-Singapore Tianjin Eco-city and the Shenzhen Bay Technology and Ecology City. In Europe, we look at a BA of a pilot smart grid project in the Malagrotta area west of Rome, Italy, contributed by the Joint Research Centre of the European Commission. The Irvine sub-project BAs use the U.S. Department of Energy Smart Grid Computational Tool, which is built on methods developed by the Electric Power Research Institute. The TEC sub-project BAs apply Smart Grid Multi-Criteria Analysis developed by the State Grid Corporation of China based on the analytic hierarchy process with fuzzy logic. The B-TEC and TNY sub-project BAs are evaluated using new approaches developed by those project teams. JRC has adopted an approach similar to EPRI’s but tailored to the Malagrotta distribution grid. Introduction: Variation across research ethics boards in conditions placed on access to medical records for research purposes raises concerns around negative impacts on research quality and on human subject protection, including privacy.Aim: To study variation in REB consent requirements for retrospective chart review and who may have access to the medical record for data abstraction.Methods: Thirty 90-min face-to-face interviews were conducted with REB chairs and administrators affiliated with faculties of medicine in Canadian universities, using structured questions around a case study (...) with open-ended responses. Interviews were recorded, transcribed and coded manually.Results: Fourteen sites required individual patient consent for the study to proceed as proposed. Three indicated that their response would depend on how potentially identifying variables would be managed. Eleven sites did not require consent. Two suggested a notification and opt-out process. Most stated that consent would be required if identifiable information was being abstracted from the record. Among those not requiring consent, there was substantial variation in recognising that the abstracted information could potentially indirectly re-identify individuals. Concern over access to medical records by an outside individual was also associated with requirement for consent. Eighteen sites required full committee review. Sixteen allowed an external research assistant to abstract information from the health record.Conclusions: Large variation was found across sites in the requirement for consent for research involving access to medical records. REBs need training in best practices for protecting privacy and confidentiality in health research. A forum for REB chairs to confidentially share concerns and decisions about specific studies could also reduce variation in decisions. (shrink)

Background Regulations on research ethics in France have evolved considerably over the past four years: the implementation of the Jardé law and of the General Data Protection Regulations have changed the landscape of research ethics for research involving or not involving human persons. In a context of creation of an Institutional Review Board at the University of Bordeaux, France, we sought to explore research ethics practices and perceptions in the medical community of our University Hospital. Methods A short (...) questionnaire was sent to all physicians of the University Hospital of Bordeaux. The questionnaire included closed questions and main topics were: physicians’ education in research ethics, ethics practices concerning researches non implying human persons, and physicians’ perceptions about current regulations. Results 86 questionnaires were sent back. If a majority of physicians have validated Good Clinical Practices trainings, there was a low rate of specific training on fundamental references in research ethics and a high proportion of responders do not consider themselves as educated in research ethics after completion of GCPs. Regulations on research ethics have many implications on medical research, especially by inducing changes in protocols in order to alleviate ethical requirements. Malpractices were acknowledged like false mention of positive opinion from an ethics committee. If If a majority of responders considers regulations as a positive answer to research ethics, a large majority considers it as a constraint and a complexification of research process. For 58%, regulations in research ethics are perceived as a hindrance for research initiatives. Conclusion Because of their impact on research process, regulations seem to constitute a scarecrow for physicians. Lack of training, bad representations and questionable practices highlight the need to improve education and to propose concrete guidance for medical researchers. (shrink)

High-spin states in the odd-odd N = Z nucleus Co-54 have been investigated by the fusion-evaporation reaction Si-28(S-32,1 alpha 1p1n)Co-54. Gamma-ray information gathered with the Ge detector array Gammasphere was correlated with evaporated particles detected in the charged particle detector system Microball and a 1 pi neutron detector array. A significantly extended excitation scheme of Co-54 is presented, which includes a candidate for the isospin T = 1, 6(+) state of the 1f(7/2)(-2) multiplet. The results are compared to large-scale (...) shell-model calculations in the fp shell. Effective interactions with and without isospin-breaking terms have been used to probe isospin symmetry and isospin mixing. A quest for deformed high-spin rotational cascades proved negative. In this paper, the structure of a southeastern Spanish population was studied for the first time with respect to its inbreeding patterns and its relationship with demographic and geographic factors. Data on consanguineous marriages from 1900 to 1969 were taken from ecclesiastic dispensations. Our results confirm that the patterns and trends of inbreeding in the study area are consistent with those previously observed in most non-Cantabrian Spanish populations. The rate of consanguineous marriages was apparently stable between 1900 and 1935 and (...) then sharply decreased since 1940, which coincides with industrialization in Spain. A marked departure from Hardy-Weinberg expectations in the ratio of first cousin to second cousin marriages in the study population was observed. The high levels of endogamy and its significant steadiness throughout the twentieth century is noteworthy. Accordingly, our results show that exogamous marriages were not only poorly represented but also that this reduced mobility suggests that the choice of a mate was preferentially local. We found higher mobility in M22 with respect to M33 cousin mating. The relationships between population size and consanguinity rates and inbreeding fit power-law distributions. A significant positive correlation was observed between inbreeding and elevation. Many Spanish populations have experienced a prolonged and considerable isolation across generations, which has led to high proportions of historical and local endogamy that is associated, in general, with high \ values. Thus, assessing genomic inbreeding using runs of homozygosity in current Spanish populations could be an additional pertinent strategy for obtaining a more refined perspective regarding the population history inferred from the extent and frequency of ROH regions. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. Doing Ethics in a Pluralistic World is an apt title for this collection of essays in honour of Roger C. Hutchinson who, over many decades, has encouraged and participated in shaping a Canadian contextual social ethics. His abiding interest in social ethics and in religious engagement with public issues is reflected in his life’s work — seeking the consensus and self-knowledge required to achieve cooperation in the search for a just, participatory, and sustainable society. One of Roger Hutchinson’s many notable (...) accomplishments is his development of a method of dialogue for ethical clarification in situations of diversity. Some of the essays collected here apply this method to specific issues, while others discuss how religious persons and organizations can and do co-operate in a pluralistic world to achieve social and ecological well-being. All essays are of keen interest to those concerned with the role and function of ethics at the matrix of religious conviction and social transformation. For nearly three decades Roger Hutchinson has been based at Victoria University in Toronto, first in religious studies, then at Emmanuel College, where he completed his teaching career as professor of church and society while serving as principal from 1996 to 2001. Washington, D.C.: The Catholic University of America Press, 2022. xiii + 272 pp. Cloth, $75.00Challenging general assumptions that, because of its genre as a letter to a king in the speculum principis tradition, Aquinas's De Regno is (...) a minor source for Aquinas's political theory in comparison to the political passages from the Summa and Sentence Commentary, William McCormick, S.J. presents a new interpretation of this somewhat neglected text. Though there exist a few classic articles comparing Aquinas's thought in this letter and elsewhere, and substantial introductions to the De Regno in editions by Eschmann (1949) and Dondaine (1979), The Christian Structure of Politics is the first book-length study of Aquinas's letter to the king of Cyprus. In this respect, the volume makes a very welcome contribution to our understanding of Aquinas's understanding of political order, bringing out a dimension of his thought—its awareness of history and its pedagogical sensitivity—not so apparent in Aquinas's other writings.The book is very much what it presents itself as being, namely, a "close reading" of the text, following the letter's two parts (the second of which [End Page 150] Aquinas left unfinished) paragraph by paragraph, considering various interpretative possibilities and suspending judgment—the words "might" and "perhaps" are no doubt two of the most frequent in the book—until more evidence comes into view, and working up to general principles only at the end. McCormick thus eschews substantial engagement with theoretical issues that would form the backdrop to the discussion (for example, the relation between nature and grace, and between practical and theoretical reason), opting instead to focus on a more immediate engagement with what is presented in the text itself. He also does not make more than passing comments on Aquinas's better-known formulations on political matters from the Summa or Sentences Commentary. On the other hand, the "close reading" does not keep McCormick from discerning a general order in Aquinas's letter, which he divides up thematically according to a proposed schema. His approach shows a sensitivity to the historical context in which Aquinas was writing, even if particular details about Aquinas's addressee and the occasion of composition remain uncertain, but his aim is not simply to produce a historical study. Instead, as the book's title itself already indicates, he investigates the De Regno in order to show that the text offers fundamental principles for a distinctively Christian approach to politics, and thus can shed light even on our contemporary situation.The book is divided into five basic chapters, in addition to a substantial introduction and brief conclusion. The first four chapters follow the order of the De Regno, though the basic lines of division are McCormick's own interpretative proposal. Chapter 1 treats the letter's prooemium and the first two chapters of part one (I.1-2) under the title "The Aristotelian State of Nature," showing that, contrary to ideas found in a certain current of Christian thought, political order is fully natural to man and not simply a practical response to violence. Chapter 2, "The Augustinian Earthly City," treating I.3-6, complements the natural character of politics with the realistic acknowledgment of man's fallen nature. While some commentators have worried that the discussion of tyranny in these and subsequent chapters of the De Regno eclipses the positive account of politics given rather schematically at the start, and so diminishes the interest the text might hold for the political philosopher, McCormick argues that the engagement with the tyrant, and the disorder he generates, represents an essential dimension of Aquinas's political vision. In lieu of an abstract, here is a brief excerpt of the content:Criminal Law, Pain Relief, and Physician Aid in DyingFaye Girsh, Ed.D., Executive DirectorMadam:The article by Cantor and Thomas on “Pain Relief, Acceleration of Death, and Criminal Law” (KIEJ, June 1996) was a tortured attempt to develop criteria for the humane and compassionate physician who tries to serve the needs of a patient in unremitting pain. There are three areas that merit comment.The authors dealt with pain medications that might (...) have the undesirable side effect of causing death. They did not mention tolerance, which usually occurs in a patient with chronic pain and which would require exceedingly high doses to be effective. They did not mention barbiturates, which are preferable to opiates in causing death and which are used increasingly by compassionate physicians to answer the pleas of their suffering patients, but for which there is no excuse about alleviating pain. Would the criminal law just call the prescription of a lethal dose of barbiturates a reckless act and require conviction? Fortunately, juries, as the authors point out, do not balance these formulas on the head of a pin. When they see the circumstances under which these doctors do help their patients, they choose to nullify the law and would ignore the suggestions made in this article.The authors refer to the “consent” of the patient. They do not mention that these doctors are operating with more than consent; they are administering these medications because suffering patients are begging them to put them out of their pain and the indignities of the dying process. The article discusses the process as though it were the same as consent to elective surgery. These patients—with AIDS, cancer, and hopeless neurological degeneration—are not simply agreeing to a procedure; they are desperately seeking a way out. If the criminal law were to develop criteria for physician aid in dying, certainly one of them should be the active, witnessed, repeated request of such a patient for a certain, quick, painless, gentle death.The third point is that physicians do not face prosecution when administering no treatment to a patient whose life could be saved with treatment but who chooses not to receive it. This has been upheld by the U.S. Supreme Court; no criteria for suffering, alternatives, terminality, justifiability, or unbearability are required. The doctor can stand by while the patient dies what may be a protracted, difficult death, but it is within the law. What matters in this situation is the decision of the patient to refuse treatment, and that is absolute. How ironic that the patient who cannot refuse treatment must, with his or her doctor, jump through all these hoops to achieve a peaceful death.One worries that the physician who must balance the risk of “risky pain relief” against the accusation of recklessness will err in the direction of allowing [End Page 103] the patient to bear the pain rather than help with a dose of analgesics that might be considered beyond the stipulated “risk.”Why don’t we just be honest about it? Twenty-four U.S. states have enacted HIV exposure laws that prohibit HIV-positive persons from engaging in sexual activities with partners to whom they have not disclosed their HIV-status. From a public health perspective, HIV serostatus exposure laws can be viewed as structural interventions that seek to limit the spread of HIV by acting at the policy level. A central premise of these laws is that informed partners are more likely to protect themselves by declining sex, by substituting less risky activities for (...) higher-risk ones, or by using condoms, than are uninformed partners. However, the effectiveness of these laws at preventing HIV transmission is not known.There is little standardization among existing HIV exposure laws, which vary substantially with respect to the sexual activities that are prohibited without prior serostatus disclosure. Among the strictest laws are those in Arkansas, Michigan, New Jersey, and Ohio which mandate disclosure prior to almost any type of sexual contact. (shrink)

Objectives: To analyse legislation and medical professional positions concerning the doctor’s role in assisted dying in western Europe, and to discuss their implications for doctors.Method: This paper is based on country-specific reports by experts from European countries where assisted dying is legalised , or openly practiced , or where it is illegal .Results: Laws on assisted dying in The Netherlands and Belgium are restricted to doctors. In principle, assisted suicide is not illegal in either Germany or Switzerland, but a doctor’s (...) participation in Germany would violate the code of professional medical conduct and might contravene of a doctor’s legal duty to save life. The Assisted Dying for the Terminally Ill Bill proposed in the UK in 2005 focused on doctors, whereas the Proposal on Assisted Dying of the Norwegian Penal Code Commission minority in 2002 did not.Professional medical organisations in all these countries except The Netherlands maintain the position that medical assistance in dying conflicts with the basic role of doctors. However, in Belgium and Switzerland, and for a time in the UK, these organisations dropped their opposition to new legislation. Today, they regard the issue as primarily a matter for society and politics. This “neutral” stance differs from the official position of the Royal Dutch Medical Association which has played a key role in developing the Dutch practice of euthanasia as a “medical end-of-life decision” since the 1970s.Conclusion: A society moving towards an open approach to assisted dying should carefully identify tasks to assign exclusively to medical doctors, and distinguish those possibly better performed by other professions. This intervention queries whether subjecting feminist jurisprudence to a methodological transfiguration toward pragrammatology (Derrida, in Smith and Kerrigan 1984) holds liberating potential for f (be it ‘woman’, ‘female’ or ‘feminine’) as both a signifier and a subject to be read with lucidity and nuance in feminist justice claims. I examine feminist jurisprudence’s methodological challenges in the settler colonial context of Alaska with respect to the murders of Della Brown (in 2000) and Mindy Schloss (in 2007). I advance my case for (...) pragrammatology as a critical methodology for feminist jurisprudence by subjecting the case(s) of Brown and Schloss to a more lucid (re)reading in two related and intersecting moves. First, I trace and deconstruct the citations of Brown and Schloss’ legal narratives to expose violence in the systemisation of f as a power and legal relation (Ahmed in Soc Legal Stud 4:55–73, 1995). I then examine the paradoxical nature of f justice claims which necessitate a pragrammatological approach. I conclude by advancing counsel on how we might move within paradox. (shrink)

The legal requirements and justifications for collecting patient-identifiable data without patient consent were examined. The impetus for this arose from legal and ethical issues raised during the development of a population-based disease register. Numerous commentaries and case studies have been discussing the impact of the Data Protection Act 1998 and Caldicott principles of good practice on the uses of personal data. But uncertainty still remains about the legal requirements for processing patient-identifiable data without patient consent for research purposes. This is (...) largely owing to ignorance, or misunderstandings of the implications of the common law duty of confidentiality and section 60 of the Health and Social Care Act 2001. The common law duty of confidentiality states that patient-identifiable data should not be provided to third parties, regardless of compliance with the DPA1998. It is an obligation derived from case law, and is open to interpretation. Compliance with section 60 ensures that collection of patient-identifiable data without patient consent is lawful despite the duty of confidentiality. Fears regarding the duty of confidentiality have resulted in a common misconception that section 60 must be complied with. Although this is not the case, section 60 support does provide the most secure basis in law for collecting such data. Using our own experience in developing a disease register as a backdrop, this article will clarify the procedures, risks and potential costs of applying for section 60 support. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement (...) constituted a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

After teaching in Sierra Leone and briefly in England, he went to teach philosophy of education at the University of the West Indies at Mona, Jamaica in 1978. The law within each legal system is a function of the practices of some social group. In short, law is a kind of socially grounded norm. H.L.A Hart famously developed this view in his book, The Concept of Law, by arguing that law derives from a social rule, the so-called “rule of recognition.” But the proposition that social facts play a foundational role in producing law is a point of consensus for all modern jurisprudents in the Anglo-American tradition: not just (...) Hart and his followers in the positivist school, most prominently Joseph Raz and Jules Coleman, but also the anti-positivist Ronald Dworkin, who argues that law necessarily synthesizes moral considerations with social facts. But which group’s practices ground each legal system? In particular, which group’s practices undergird U.S. law? Positivists since Hart have universally pointed to either officials or judges as the “recognitional community” (my term): the group such that its rules, conventions, cooperative activities, or practices in some other sense are the social facts from which the law of a given legal system derives. So Hart and all other positivists would identify either U.S. officials or U.S. judges as the recognitional community for U.S. law. This Article grapples with the tension between the positivist’s official- or judge-centered account of the recognitional community and the “popular constitutionalism” now so widely defended by constitutional scholars such as Larry Kramer, Robert Post, Reva Siegel, Mark Tushnet, Jeremy Waldron, and many others. Surely the popular constitutionalist would want to claim that U.S. citizens, not judges or officials, are the recognitional community for U.S. law. I term this position “deep popular constitutionalism.” Indeed, it turns out that Dworkin’s account of law, in its ambition to generate associative moral obligations for the citizenry as a whole, implies deep popular constitutionalism. Here there is a disagreement, hitherto unnoticed, between Dworkin and the positivists. My solution to this disagreement – to the debate between deep popular constitutionalists and deep official or judicial supremacists -- is to dissolve it by providing a group-relative account of law. Social norms, such as norms of dress or eating, are clearly group-relative. A particular dressing or eating behavior may be socially appropriate relative to one group’s norms, yet socially inappropriate relative to another’s. This Article extends the group-relative view from social norms to law itself, with a particular focus on U.S. law and constitutionalism. Part I surveys the jurisprudential literature. It shows how Hart and successor positivists identify the rule of recognition as a social practice engaged in by officials or some subset of officials (judges), rather than citizens generally, and argues that Dworkin by contrast sees the citizenry as a whole as his recognitional community. Parts II and III defend a group-relative account of law. Part II argues, with reference to the U.S. experience, that multiple groups can simultaneously instantiate the kind of social fact that undergirds law, be it a convention, a social norm, a “shared cooperative activity” (SCA), or something else. At many points in U.S. constitutional history, multiple official or citizen groups, defined along departmental, partisan, regional, state-federal, religious, or other lines, have accepted competing rules of recognition for U.S. law. Part III argues that “law” functions, primarily, as either an explanatory or a normative construct, and that insisting on a single recognitional community for each legal system would be arbitrary, both for explanatory purposes and for normative purposes. Part IV considers the many implications of the group-relative account for U.S. constitutional theory – in particular, for popular constitutionalism. (shrink)
